General Terms & Conditions for Participation in Competitions

1. Introduction
1.1 These general terms and conditions for participation in competitions, organised by Universum Communications Sweden AB (org. 556587-5993, Jakobsbergsgatan 22, 111 44 Stockholm (“Universum”), and featuring in any of Universum’s websites and/or digital platforms offered to students, professionals businesses and any other third parties (“Users”).


1.2 By participating in Universum’s competitions, Users are deemed to have accepted and understood, and agree to be bound by (i) these General Terms and Conditions; (ii) the specific instructions, rules and conditions of the announced competition, and (iii) any and all of Universum’s guidelines, policies, instructions, codes of conducts or standards applicable from time to time, generally published at https://universumglobal.com/, (jointly referred to as the “Terms”).


1.3 Instructions, rules and conditions specific to each competition are either disclosed and displayed on the website for the specific competition(“Competition Notice”), or another digital platform. In the event of discrepancy between these General Terms and Conditions and the Competition Notice, the Competition Notice shall prevail.


1.4 Universum may need to change the Terms from time to time for any number of reasons (including to compliance with applicable laws and regulations, and regulatory requirements). All changes will be published at Universum’s website and/or digital platforms. Users’ continued participation in the announced competitions, after the date on which the changes to the Terms come into effect, is deemed as an acceptance of the changes to the Terms. Users not accepting the Terms are encouraged to inform Universum in writing without undue delay (contact@universumglobal.com).


1.5 Users are responsible for determining whether their participation in a competition is compliant with applicable laws in the Entrant’s jurisdiction. Furthermore, Users participating in a competition entailing a competition warrant that their participation is not illegal in the territory where the User resides.
If you do not agree to the terms or any of Universum’s guidelines, policies, instructions, and standards, please do not participate in any competition held by Universum.

2. Disqualification
2.1 To qualify as a User of a competition entailing a competitive element, the User must reside in the geographic locations indicated in the Competition Notice. The User must ensure that the contact details provided with the requested competition’s submission is correct, as the contact information may be used to send the User information, further instructions and awards (where applicable).
2.2 Unless otherwise provided in the Competition Notice, employees of Universum and their immediate families, persons connected with a competition and their immediate families, such as, sponsors of awards and their agents are not eligible to enter the competition event.
2.3 By participating in a competition, Users warrant that all information submitted by the User is true, current and complete. Universum reserves the right to verify the eligibility of all Users.
2.4 Universum assumes that by participating in a competition, the User warrants that it satisfies the age limits set out in the Competition Notice or the Terms.
2.5 If Universum discovers, or has reasonable grounds, that the User has made more than one entry, Universum is entitled to disqualify the User. If the winner of such event is a User with more than allowed entries, Universum may disqualify the winner and selected another User as the winner.
2.6 Universum reserves the right to disqualify discretionarily the User if Universum has reasonable grounds that the User does not satisfy the requirements to participate in the competitions or if the User is in breach of the Terms.

3. Participation in competitions
3.1 Only one entry per person per competition is allowed (except where the Competition Notice states that more than one entry can be submitted) and any User entering more than the permitted maximum will be disqualified.
3.2 Unless otherwise provided in the Terms, Users may take part in a competition only by completing and submitting the enquired information according to specific requirements set out in the Competition Notice or individual instructions announced and/or communicated by Universum for the specific competition.

3.3 If participation in a competition entails submission of information, any submission must be made in the manner and by the closing date specified on the Competition Notice. Unless otherwise decided by Universum, failure to do so will disqualify the User from participation in the concerned competition.
3.4 Unless otherwise provided in the Competition Notice, participation in a competition organised by Universum is free of charge.

3.5 Proof of posting or emailing is not accepted as proof of delivery. Universum does not assume responsibility for any errors, omissions, interruptions, deletions, defects, delay in operation or transmissions, communications line failure, destruction, alteration of, or unauthorised access to submissions, submissions lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes.
3.6 Unless otherwise provided in the Competition Notice, Universum is not responsible to return any contents or material that the User has submitted to Universum (including, but not limited to, artistic or other contents or material).

4. Winners and awards
4.1 Winner of each competition is chosen on the basis of the specific conditions set out in the Competition Notice and only qualifying Users participating in the event are eligible to be selected winners for that competitive event. Winners are notified in the manner and within the time periods specified in the Competition Notice.
4.2 In all matters, the decision of the appointed judge(s) shall be final and binding to all Users, and no correspondence or discussion shall be entered into.
4.3 Return of any award notification, as undeliverable or failure to reply as specified in the notification (and within the time stated), may result in disqualification and selection of an alternate winner. If more than one award is awarded only one award per User will be awarded. Competition winner(s)’ names may be publicly disclosed by Universum on the relevant website.
4.4 Claims for an award must be made in the manner and within the time specified on the Competition Notice. Failure to claim an award within this time or in the manner specified may result in disqualification and selection of an alternate winner.
4.5 Awards are awarded at the discretion of Universum and no awards will be awarded as a result of improper actions by or on behalf of any User.
4.6 Unless otherwise stated in the Competition Notice, awards are non-transferable, and the Users are not allowed to substitute or request for other monetary alternatives.
4.7 The winner claiming for an award is liable for any taxes, levies, administrative fees, insurances, transfers, or any expenses (as the case may be).

5. Intellectual property rights
5.1 Unless separately agreed with the User, Universum does not claim any rights of ownership to the content or material submitted by a User pursuant to Section 3.2 above. Notwithstanding, Universum retains the right to use the information submitted by a User for the purposes set out in the announced Competition Notice.
5.2 By submitting information in response to a Competition Notice, the User agrees to Universum’s (and third parties authorised by Universum) use of that information and grants Universum a worldwide, non-exclusive, royalty-free, and transferable license to use, reproduce, distribute, prepare derivative works from, edit, alter, store, reformat, sub-license or display the information for the purposes of the Competition Notice.
5.3 Universum does not warrant that information submitted for the purposes of a competition is made available on its website. Universum may, at its sole discretion, reject, edit, remove or disable access to the information a User has submitted in response to a competitions, in particular, if Universum has grounds to suspect that the information infringes the copyright or other intellectual property or privacy rights of third parties, or if the information is of defamatory nature, or for any other reason.
5.4 The User hereby warrants that the information submitted and/or disclosed to Universum does not infringe the intellectual property, privacy or any other rights of any third party, and will not contain any material that is unlawful, defamatory, indecent, harassing or threatening. Where applicable, Universum reserves the right, at its own discretion, to screen, filter and/or monitor the information submitted by the User and to edit, refuse to distribute or remove that information.

6. Indemnification
6.1 Insofar as is permitted by law, Universum shall be held harmless for any damages, loss, injuries or disappointments suffered by any User participating in a competition or resulting from accepting any awards. Furthermore, Universum is not liable for any technical or administrative malfunctions, errors or defects (such as computer on-line systems, servers, or providers, computer equipment or software, failure of any email or any web site) resulting from a User’s participation in the competition. Universum shall be released from any and all obligations upon transfer of the award or decisions adopted by appointed judge(s). Universum shall not assume any liability for material defects of the awards.

7. Privacy and data protection
7.1 The User acknowledges and agrees to Universum’s processing of the User’s personal data for the purposes of the competition, including but not limited to disclosure and publication of the winning User’s name on its website or other media.
7.2 All processing of the User’s personal data will be made in accordance with Universum’s privacy policy, unless otherwise is expressly stated. You can find the privacy policy at the bottom of every page on the Universum Sites, as well as here.

8. Applicable law and dispute resolution
8.1 The Terms shall be governed by the substantive laws of Sweden. Any dispute, controversy or claim arising out of or in connection with the Terms, or the breach, termination or invalidity thereof, shall be finally settled by the Swedish General Court in Stockholm.
